Tech Privacy in India: A Student's Guide

Navigating the Digital Panopticon

When we founded Slashdot at IISER Kolkata, our primary goal was to close the gap between theoretical computer science and modern framework tooling. However, writing good code is only half the battle. As developers and citizens, understanding the socio-technical ecosystem where our applications operate is equally vital.

India is currently undergoing an unprecedented digital transformation. From instant UPI payments at the campus canteen to accessing essential government services online, digital infrastructure is deeply woven into our daily routines. But as our digital footprints expand, it is crucial to objectively examine how our personal data is handled, governed, and protected.


1. The Foundation: Digital Public Goods and Policy Wins

To discuss digital privacy accurately, we must acknowledge the structural successes that have brought hundreds of millions of people into the formal digital economy.

  • Digital Public Infrastructure (DPI): Frameworks like UPI and the Account Aggregator ecosystem have revolutionized peer-to-peer transactions and data sharing. By utilizing open digital protocols, India has reduced its reliance on closed, foreign tech monopolies and empowered citizens with more seamless financial tools.
  • Direct Benefit Transfers (DBT): The digital identity stack has successfully minimized bureaucratic friction, allowing welfare subsidies to reach beneficiaries directly and efficiently.
  • Legislative Milestones: The landmark 2017 Supreme Court ruling in K.S. Puttaswamy v. Union of India cemented the Right to Privacy as a fundamental right. Following this, the Digital Personal Data Protection (DPDP) Act was introduced to establish baseline standards for how corporate entities process user data, complete with mandates for clear consent notices.

2. The Balancing Act: Complexities in Data Governance

While the infrastructure scales beautifully, the balance between state administration, national security, and individual civil liberties remains a complex, ongoing conversation. International tech policy watchdogs and independent researchers often emphasize that rapid digitization must be accompanied by equally robust checks and balances.

Rather than viewing these issues in black and white, it is helpful to look at the areas where policy researchers suggest room for improvement:

  • Administrative Exemptions vs. Judicial Oversight: Organizations like the Internet Freedom Foundation (IFF) have observed that the current data protection frameworks grant significant exemptions to state agencies for "public order" and "national security." Policy experts advocate for stronger, independent judicial oversight to ensure these exemptions maintain a healthy digital ecosystem without overreaching.
  • Network Reliability and Access: According to tracking by Access Now's #KeepItOn Coalition, there is a frequent administrative reliance on localized internet blackouts. While these are deployed primarily as law-and-order measures, watchdogs note that they severely disrupt digital commerce, education, and fundamental civil connectivity.
  • Security Technologies and Surveillance: Collaborative investigations by Citizen Lab, Amnesty International’s Security Lab, and Freedom House have pointed to the necessity of deeper regulatory scrutiny. They highlight concerns regarding the deployment of commercial surveillance software (like Pegasus) and the widespread use of facial recognition technology (FRT) without stringent statutory backing.

3. Practical Digital Hygiene: How to Keep Yourself Safe

You do not need to be a cybersecurity researcher to protect your privacy. By adopting a few deliberate habits, you can drastically reduce your exposure to data brokers, identity theft, and unwarranted profiling.

Identity and Authentication

  • Use a Masked Aadhaar: Never share a full photocopy of your 12-digit Aadhaar card for routine verifications (like hotel check-ins). Download the Masked Aadhaar directly from the UIDAI portal, which obscures the first eight digits.
  • Biometric Locking: Your biometric data is sensitive. Use the official mAadhaar app or the UIDAI portal to keep your biometrics locked by default. Only unlock them temporarily when you are actively completing an authentication request.
  • Upgrade Your 2FA: SMS-based OTPs are vulnerable to SIM-swapping attacks. Shift your critical accounts (email, banking, GitHub) to an Authenticator App like Aegis, 2FAS, or use a physical hardware key.

Device and Application Security

  • Audit App Permissions: Regularly review your smartphone settings and revoke microphone, camera, contact, and precise background location permissions from apps that don't strictly need them (e.g., a calculator or a food delivery app).
  • Secure Your Communications: Shift your sensitive personal conversations to messaging platforms that utilize verified end-to-end encryption by default, such as Signal. Utilize disappearing messages for temporary information.
  • DNS-Level Protection: Configure a privacy-preserving DNS service (such as NextDNS or Quad9) on your devices. This acts as a protective shield, blocking tracking domains, malicious telemetry, and intrusive ads before they even load on your network.
